1778. 3 Term. [Wednesday] July 8th.
not very clearly express’d in the Statute.
There was also a Plea of the General Issue on this Record, which is not now decided, but remains to be tried in it’s turn among the other causes in the Paper.
After this Judgment on the Demurrer we proceeded to the Trial of an Action of Trover
The Reverend Marcellio Joseph Ramalhete, Clerk
v
Augustus Norton.
Among other Evidence at the Trial it appear’d the Plaintiff was to conduct a Fleet of Boats laden with Salt belonging to the Defendant from Calcutta to Patna. That beside the Salt belonging to Norton which was loose, there were Six Hundred Bags of Salt on board the Boats, 300 of which were the property of the Plaintiff, and three hundred the Property of a woman whom Norton kept: that by the way some of the boats laden with Salt were lost: and by that means some of the Bag Salt was lost. The Rest of them were sold; three Hundred by the Plaintiff at Rajemahl; 300 by the Defendant at Patna.
