The case most relied on by Mr. Justice Hyde & Sir William Jones was that of Fabrilius & Cock above quoted. Chambers did not in the smallest degree disapprove of that case, the justice & reasonableness of which he admitted, but he did not think there was so the much reason for in the present case as in that for believing that the judgment had been obtained by Perjury.
And after some debate about Costs the Court agreed to defer the [ILL] of Costs on the former Trial till the event of the New Trial should be known.
