1778. 4 Term. [Friday] Nov. 6.

Nilmoney Gose
v
Rogonaut Bonarjee.

[Triple Line]
An Action on the Case, to recover money due on an account settled.
The Defence attempted was duress, that he was compell’d to sign it, by a Peon being order’d to keep Mosussil, that is, Watch or Guard over him. But I think no such compulsion was ever Sworn by the Defendants Witnesses as would make it void for duress.
After going through all the Evidence on both sides, I adjourn’d the Cause for the Plaintiff’s Advocate to reply, till to morrow, my brother Chambers being gone home before the Evidence was finish’d.
