Mr. Tyler stopt the officer at the Top of the stairs, and as his own Wts (Nickles) has now sworn, he [ILL] the Plf Deft who down. – who did not once touch him; tho’ kicked by him & beat by Mr. Griffin.
The Court however thought that, as the weight of evidence hitherto given, opposes the [ILL] of Son assault demesne; although Nickles by his Testimony has supported it, - which the Deft ought to give such further evidence he can in support of it.
