This was a very frivolous action for going to the Plaintiff’s Tank. The Defendant Justified that and breaking down the Wall to go to the Tank, by a right to the use of the Tank. The Plaintiff’s Witnesses proved the right of the Defendant therefore there was a Judgment Non-Suit, with
