without beginning any suit agt DaCosta, bailable process was by Dacosta taken out agt Hamilton; by means of an aft that H: was indebted to him in CR 93611, on a bond in the penalty of 150,000 CR, reciting the indemnity clause, & then asserting that he had on the 20 June 1786 pd said sum of CR 93611.
Whereas if agt Dacosta an adverse suit had been brought, no [ILL] sum cod have been recovered.
