conceive to be suffict viz that Da Costa had a good defence to make agt Herbert’s Demand but wanton [ILL] relinquished it & paid the money in order that he might sue the bond of Indemnity. Ano is his having paid more to Herbert’s atties, than could be legally enforced.
Anor is that B. & C were not authorized to give fit & legal discharges in the name of Herbert, & therefore tho’
