G. Herbert, and in which 10 per cent, per Ann is reserved for interest & a penalty of 10 per cent on the whole, in case the money [ILL] with 5 pr cent int is not pd in England.
But no man can legally receive more than 12 per cent, and a contract for receiving more is usurious. I conceive that the reservation, of that penalty in addition to the interest makes the bond usurious & void abinitio.
