The Witnesses for the Plaintiff were all examined, and then Mr. Davies Insisted that the Plaintiff must suffer a Non-Suit, for the Tin, the Value of which was the principal sum intended to be recover’d, was proved not to have been converted to his own use by the Defendant, but to have been plunder’d by the Marrattas, the Rice has been proved to have been the property of the Company, and none of the trifling articles introduced into the Plaint by the Attorney, very cunningly in order to secure
