and the Issue Join’d was immaterial, the Court were of Opinion there ought to be a Repleader: yet Mr. James Dunkin and Mr. Ledlie; Advocates for the Defendant, not choosing to move for a Repleader, the Court would not award it without Motion, but would have given Judgment for the Plaintiff, on the Admission of the Execution of the Bond contained in the Defendant’s Plea, but the Court declaring that intention, Mr. Dunkin, Moved for a Repleader and Mr. Davies opposing, a Rule was Granted for a Repleader, unless Cause
should
