We have been desired to stay this Money in the hands of the Sheriff, and to direct an Issue to try whether the Contract was usurious, but though it appears this has been done in some Cases in England, yet we see difficulties in doing the like here, and tho’ we do not say that it can not in any case be done, yet we think this is not a case for it, and the rather because the Parties are not without remedy for they will be intitled by Bill in Equity
