Mr. Lawrence. Now opposed the Motion.
The argument brought by Mr. Brix to prove Malice from the Length of time from the commission of the Fact to the time of the Indictment, will fail, if Mr. Brix will recollect what he knows very well, that the most material part of the Indictment, which charges the Publication, means what pass’d in an Action which was tried only a few Months ago.
In that Action the Court in giving their Judgment declared the Dammages were given only to a certain day in April, and that if the Plaintiff Nauderah would seek redress for any Injury it must be against other Persons, and immediately after an Action is brought for the Imprisonment, against the Gentlemen at Patna, and then they became Parties
