A Non Suit. The Plaintiff’s Attorney said the Witnesses were all with him this Morning and he order’d them to come into Court but none of them were now here. Though the Cause had been open’d, yet no evidence having been given, the Advocate for the Plaintiff would have stricken the Cause out of the Paper, and the Court were willing to indulge him in suffering him so to do, but it being alledged by the Advocate for the Defendant that the Defendant was in Prison, and that the Plaintiff had several commenced actions against him, and as soon as he had put in bail, had
