Plea Non assumpsit except as to 475 SR & issue joined thereon – And as to that sum Deft says Plf ought not to recover any Dams for nonpayment thereof beyond the sd SR 475 bec: he says that after the promise supposed to be mde, & before the suing the Origl Writ, viz 24 Mar: 1787, he was read & offered to pay, & tendered to Plf the sd SR 475 which they refused to accept, & from that time he hath always been ready, & in ready to pay sd SR 475 & he bringeth the same into Court to be paid to the, if they will accept
