Jt for Plf against both Defts
NB. The Judges in this case had some doubt whether Jt hould be given agt both Defts or only against Ullman, it not being clearly proved that Forbes was usbj: to the Jurisdon. Mr. Bondfield sd β€œhe believed Forbes to be a scotchman, & knew him to be residt in Bengal where he has lived 4 years; that his only reason for believing him to be a Scot was his accent; - but he added that he had been connected with him in Trade, that he had no doubt of his being a Scotchman and had no reason to suspect him to be a foreigner, & did not know that he cod speak any foreign language.” – We thot that in a civil cause, & where an Advoc: appears for the Deft this should be considered as prima facie evid: [which] the Deft shod be called upon to answer. It was not answered & Jt ut supra.
