Decrees come next to Jts, but, are if so considered, they are inferior to Judgemts. I conceive however that, since they have been considered in Equity as equal to Jts, they may be pleaded at Law in opposition to Bonds. Though I admit that Lord Talbot appears to have thot otherwise.
Mr. Davies says the Defts ought to have relied on a Devastavit in Equity if there was one. But I conceive it is sufficient for Defts to state the facts & leave to the Court to determine wr there has bn a devastavit.
