Mr. Davies desire to observe on some cases of Law quoted in support of the Rule.

They are all cases of Exors who are Plfs at Law except one which relates to a Sci: fa: & depends on the words of the Stat:
As to Bird & Culmer – I do not see how a man can plead plene administravitu & at the same time acknowl the Action – unless he withdraws his plea but the book is not quoted at Length.
Some old cases have been
