Defts are averred to be inhabits of Calcutta therefore subj to the Juridon, & also to be sons Hrs and legal represents of Modun Mohun Dutt, a Hindoo Native of Bengal, deceased, & by the laws of Hindoos entitled to the admon of the effects & chargable with the Debts, of deceased.

After these averments follow 2 several Counts viz

a. states a bond of Fras Gladwin to Plf d 12 July 1783, in penalty of 31666 S.R. condon’d for paymt of 15833 wth 12 pr cent payable 2 months after date & that 15 Aug 1786, the same being still due, the deced M. Dutt, in cous on of further time given till 22 Oct 1786, promised to become security for 10000 & that he would pay the same when reqd – time given & a Breach averred.
