Mr. Cassan moved for a commission to two gentlemen at Chittagong to swear a third to the truth of an affidavit, which appeared to me merely a voluntarily one. It was entitled in the goods of Bowen but it was not alleged that it had anything to do with the caveat entered in those goods, with any suit subsisting. –

I therefore being alone on the Bench refused it.
