Only to speak to his character. Delany had obtained subponas for the following persons whom he supposed to be at Berhampoor.
Adjutant Dove – who is not attending the Court on the part of the prosecution.
Sergt Loun, who, as Prisr says, can prove that Marshall (Wts for the K.) said at one time that there were 2 seals to bhe Watch & at another time that there was only one
Serjeant Lewis – Do.
Serjeant Winter – to speak to his character.
Corporal Messer – to prove that Prisr was at home in the Hosp on 12 Dec., which is totally immaterial, the robberty having bn com 15 Decr.
Peter Gibbs – to prove that prisrs life had been threatened & [thus?] he had good cause to keep a pistol
3 other Wtses to prove that he came lawfully be a golden anchor & a watch concerning which there is now no charge agt him.
The Court did not think that it was recessary to interfere in any extraordy nammer to get such Wtses subponad, & much less did they think it proper to defer the Trial till next Session of a man who has once escaped out of the Gaol.
