Mr. Newman, Moved in a Cause and Mr. Brix consented: Mr. Litchfeild observed to the Court that there was were not sufficient Grounds for the Motion, for though there was a Certificate that Issue was Join’d, there was not a Certificate that the Issue was not Tried.
Impey. The Prothonotary is right: Though there is a consent, yet the proper grounds ought to be laid where it is to be by Certificate, otherwise the Officer loses his proper Fees.
Mr. Litchfeild, the Prothonotary, gave a better reason, though that was meerly a reason from the form of the Order: he said the Rule was always drawn on reading such Certificates, and on the Consent of Council
Mr. Newman, Undertook to file the additional Certificate of the Prothonotary, and thereon the Rule was made.
There were no Motions of any importance.
