Interlocutory order of this Court by which Keighly’s Plea was overruled, & from which he desired to appeal; I now delivered their unanimous Judgemt: that the appeal (which has been filed) shall be allowed.
I observed, speaking for myself, that it does not follow, as a consequence of this decision that every order in an Equity cause may be the subject of an appearl, for I observed that if upon an order for four days further time to answer, or other like order, being made, an Advocate were to present an appeal agt it, I should consider it as trifling with Justice & with the Court.
