Affidavit of W. T. Jones stating that he is willing & has always been willing to deliver up every thing on receiving his costs, which costs or the right thereto he has mortg to Mr. Smoult who paid a sum of money above 10,000 SR to him from going to Jail; but that Mr. Solom: Hamilton, being Mr. Palmer’s Attorney, and knowning that the costs were so mortgd to Smould, has, with that knowledge, assigned over to Mr. Palmer a bond from Jones to himself, which Palmer insists upon setting off agt Jones’ bill of Costs.
