Another position mentd by Mr. Ja Dunkin was that the Statute can not be pleaded to a discovy when the debt xxxrued. This was proved by anthorities & applies to the present case.
The pleas are meant to be two. 1 Stat: of Frauds & Perjuries 2. Stat: of Limitations. But the second Plea is double having in the middle of it, a clause about the Mayor’s Court which seems to be foreign to the Plea, and if it has any thing to do with it ought to allege that the Mayor’s Court was a Court of Equity.
