As to the averment. It is observable that in all the cases of a plea to the Stat of Frauds an averment is inserted denying that which would take it out of the Statute.
I believe that no case can be found in which the 2d clause of the 4th Section of the Stat of Frauds has been pleaded to a Bill for a Discovery – viz “or shereby to charge a Deft upon any special promise to answer for the debt &tc of another”
