In a case of Spalding & Aspinshaw v Candlev & Nicol, Mr. Davies moved to set a cause down ex parte for want of a Plea on a certific of Cl of papers signd this morning that no plea was then filed, but the Clerk informed the Court that since that certificate was taken out a plea had been filed. Mr. Davies quoted the cases of Oxley v Bridge in Douglas 67, [1] and Haselar v Ansell, Douglas 197,
