The house at their own separate expense, & lived in it separately, they had only a little to one half of the ground, nor ever conceived they had more, but that being distressed for money, & thinking their half equal in value to the sum borrowed, they did mortgage the whole without the consent of their brother Bridjooram or their nephew Neelmoney Doss; that Ducory got Judgement against them in an action at Law, and brought the Land subject to the claim of Modun Gopaul Bose.
The answer of Mr. Richardson is that he sold the Land as Sheriff at auction, under execution in a Common Law action, that Ducory Bose, who was Plaintiff in that action against Sassaram Doss and Menick, became himself the purchaser at that sale for three hundred & five Rupees, that he sold subject to the mortgage of which Ducory had notice, but that he never completed the sale by putting Ducory in possession, because he found there were disputes and he was not indemnifies.
