Witht any reasonable or probably cause, suspended him from his office, per quod he losts his profits, &c. On the evidence it appeared, that Genl Munay had legal authority to suspend till the King’s pleasure was known; that he had so suspended him, & directed the Secretary of state to take the King’s pleasure on it. The Genl professed himself ready to restore him if he made a particular apology: the King approved of the suspension, Unless the terms were complied with. There the Plf recovered 5000 L & it never occurred to any lawyer, that there was any pretence to move in arrest of judgmt. The gist of the action was admitting the legality of the suspension thus confirmed, but complaining of the deft’s exercise of his originl authority, & his malicious & galse representations, by wch the suspension had been confirmed.
I trust the Court will think this case particularly proper for a court of Equity, without the aid of which, Deft cannot be obliged to render an accot of the profits he has illegally recd.
