Determined that a comding offr acting under the general powers incident to his office is not liable to an Action for removing an offr under his comd. If so how much more clearly must this be true when the Commander acts under special Authorities particularly conferred on him.

Suppose this were an Action at Law, and that the action wod lie, it would be necessary for the Plf to prove malice, which had not bn attempted, & the wants of a prob cause whereas an honest & laudable cause appears probably to have actuated the Deft.
