6. The invasion of a man’s house. If an indictmt be found against a man for Burglary, & the petty Jury find that the prisr stole the goods, but that he did not break and enter the house, or that he did not do it by night, they may find the simple Larciny.
Sir W. J. thinks that the breaking and entering an Apartment in a house, though that apartment be open at the tap is a burglarious entry.
