Augustus Norton.
An Action on a Policy of Insurance, on which, Augustus Norton, who is what we call a Portuguese, and has of late stiled himself a Merchant, had underwritten Two Thousand Rupees, but although all the other Under-Writters had paid the loss, Norton had not.
The Ship was proved to have sail’d from this Port and afterward from Masulipatam above two years ago, and never afterward to have been heard of, which is deem’d according to a Case in Strange, sufficient proof of a total loss by Foundering at Sea.
The Interest of the assured, and the Value exceeding the Sums insured were proved.
The Subscription of the Defendant was admitted.
