1781. 2 Sittings. [Monday] April 2.
Of High Rank, who was Zemindar of Siedpur in Jessore, and the Widow was in possession of the Zemindary after the Death of her Husband. She imploy’d the Defendant as her Dewan to make the collections, and the real demand in this Action is about Thirty Six Thousand Rupees, which is the true balance of his account, but the Plaintiff will be obliged to prove the whole Sum received by the Defendant, and let him prove the discharge of what part he can. The dispute between the Parties is really concerning some Sums of Money which the Defendant gave as Bribes to keep himself from being turn’d out of his office of Dewan, which he has charged in his Accounts as paid for the benefit of the Plaintiff. The Defendant has given a Notice of Set-off, and we suppose he will endeavour to prove the payment of these Sums under this Notice of Set-off, and we suppose he will endeavour to prove the payment of these Sums under this Notice, but he had no authority from the Plaintiff to make these payments.
