was Military Store-Keeper at Fort William in Bengal, Govindram would afterward settle Ramchunder’s account according to such account as Ramchunder should settle with Mr. Darrel: Therefore the Court are of Opinion this Note can not be admitted in Evidence on the Count of Insimul Computassent on which it is offer’d, both on account of the Duress, and of the occasion of giving the Note. The Plaintiff attempted to prove articles of money received, in order to recover so much, on the Count for Money received to the use of the deceased, but she fail’d in that proof, because the Witness could not speak to the Sums without reference to large Volumes of Bengal Accounts, of which she had not procured Translation: Therefore the Court were of Opinion that the Plaintiff must now suffer a Non-Suit and might come better prepared another time.
