The Defendant was committed by my Warrant dated about ten days before the beginning of this Session, charged with Perjury, in swearing an affidavit of Debt in a Cause, and an Indictment was found against him, on which he was now put to the Bar, and intended to have been now Tried, but the Chief Justice ask’d Mr. Lawrence in what state the Action was, and Mr. Lawrence, Advocate for the Prosecutor, who was Mr. Henry Halsey, or his Gomastah, answer’d that the Cause was still depending, and had not been tried: on which the Chief Justice said, then the Prisoner could not be tried, but the
