Contradiction of Witnesses, because the Woman appeared to be more worthy of credit than Gowr the Man, who evidence contradicted his own written testimony, and who also appeared and unwilling Witness for the Plaintiff, on whose part he was called.
The Pottah was produced by the Plaintiff, and though the Pottah was in the name of the Defendant yet we thought it would support the title of the Plaintiff who claimed by purchase from the Defendant.
The Defendant produced no Witnesses.
Judgment for the Plaintiff.
