Mr. Davies, As soon as Sir Robert Chambers came, Insisted there must be a Non-Suit, it appearing by the Plaintiff’s Witnesses nothing was due, because the time of payment was to be after the sales of the Dutch Company and it has not been proved those sales have even now been made.
The Court were unanimously of Opinion, that according to the Evidence now given the Money was due in Six Weeks after the
