1790. First Sittings. [Wednesday] Feb. 24.

Mr. Davies, Moved that the Court would give permission to move in the next Term, that a Judgment of Non-Suit should be enter’d: or a Judgment for the Defendant. He said this was similar to what was frequently done by Lord Mansfield when he sate at Nisi Prius.
But the Court unanimously refused to do this, and said Mr. Davies might, without leave, move for a New Trial, and as had before in some Cases been done, it might be granted in the like cases, as a New Trial would be granted in the Courts of England.
