The Fact Stated was that he was an Inhabitant of the French Settlement at Chandernagore, and could be sued only in the Court there called the Cutcherry, when the Cause of Action accrued, and that he was brought to Calcutta at the time the cause of Action arose as a French Prisoner of War, and was not otherwise Resident in Calcutta, than as a French Prisoner on his Parole of Honour.
