them that, if they wod lend sd sum of 100000 SR, he wd pay & satisfy the sd sum to them when required; & they in fact say that relying on such promise & in compliance wth Deft’s request, they did lend & add to N. Mull 100000 S.R. of which Deft had notice, & was requested to pay.
10. Co: for that Plfs, at the request of Deft had obt & pd to sd N. M. Miter, 100,000 SR in conson whereof Deft promd to pay the sd last mentd sSum, when he, the Deft, shod be requested.
11. Co. for that on sd day & year N. M. Miter accounted togr with the Plfs, of & concerning other sums of money due from him to them, & then upon that accot he was fod in arrear to them in the sum of 100000 SR in conson whereof the sd M. D. undertook & promd to pay sd sum to Plfs, when requested.
Neglect & refusal to pay stated
