Trial
On the 24 Bhadur 1195 wts went to Mr. Dawson in Calcutta on accot of money, having 1st sent him a lr by Siama Lall, to [which] he had answd that he wd come & settle, & pay the money due to the house, by the 1 June.
Convers— related.
Wts cannot tell for certain wr B is the letter Siama Lall brot to him from Deft – but says that letter had the initials of the Deft’s name to it.
Another Convers— related
Deft desired me to prodc: that lr I told him I would not prod: the origl but &c – pa: 4.
at a third interview gave him a copy of it – Conversation about it.
The Deft pd 25000 Rs in Cartic 1195 & bid me make out an accot & get it signed by Nilmunny Miter, saying “whatever Bal sl appear due on such accot I sl pay without any objection”. I told this to Monohur Dass, who thereupon sent Siama Lall to Moorshedab: to comp: his accot with N. M.’s and to N. Miter to sign &c. He went & brot down to Calc: a Beng: accot of [ILL] & also an accot signed N. M. in which a Bal was struck. Deft then gave an order on Cockerell for 16000 Rs – The acot signed by N. M. is Exh: C. what Deft sd when he saw it, See sheet 4. See the rest of the Depos in chief, on this head, & respect the comparison of accost which Deft desired might be made by Saut Cowri Bhatacharje [the cashkeeper) Gungadhur and the satisfaction given to them.
For the Croll Examination so far as it proceeded on this day see the last leaf but one at this mark – +
No. 3. Deft’s Advoc admits M. D. on Exh: B to be Deft’s writing.
No. 4. W. C. Blaquiere 2d Wts for the Plf.
Exh. B is truly translated. D is a copy thereof & the transl— annexed to D is I think rather closer than that and to B. but I do not think that they differ materially from each other.
