And Sir Robert Chambers, in particular said that this was such a single transaction as would not before a Jury of Merchants of London be permitted to be recover’d under the Count of Insimul Computassent. The Plaintiff was not prepared to prove the agreement to pay the difference of the two sales as stated in the only other Count in the Plaint, but was therefore non-suited.
