Mr. Sealey, Advocate for the Plaintiff on the Insurance Bond.
The signing the Bond, the Receipt of the Premium, and the loss of the Ship were admitted. The Question is whether this bond is void, either as a fraud on the under-writer by his not knowing that the Respondentia Bond mention’d in the Insurance Bond was given, not for money actually Lent, but for a Bond given instead of money by the Person call’d the Lender on the Respondentia Bond.
Or whether the Insurance bond is void by the Section of the Act of 19th G. 2d chapter 37, which prohibits re-assurance.
