Sittings after First Term
thereof; and after mentioning also the papers read on the part of the Defendant Wyatt, the Order proceeds thus – “On reading whereof and by consent of the advocates on both sides, It is Ordered that upon security being given by the said Complainant by Recognizance or Bond of Messieurs John Burgh & Charles Barber in the penal sum of thirty four thousand Sicca Rupees to abide & perform such Judgemt Orderer Decree as this Court shall think fit to make at the Hearing of this Cause, and, upon Complainants amending his bill of Complaint by adding in the prayer of the said Bill the words or alternative following viz “or that the Defendant Charles Wyatt may come to a just and fair account with the Complainant respect the premisses in the pleadings in this cause mentioned and that upon such account being so taken the Balance found on the same may be Decreed to be paid to the party to whom the same shall be found due” a writ of Injunction do issue out of and under the seal of this Court to stay Execution in an action at Law, on the Plea side of this Court in which the Defendt Charles Wyatt is Plaintiff and the Complainant James Augustus Grant is Defendant, until the said Charles Wyatt and William Mackintosh shall have fully answered the Bill of Complaint of the Complainant in this Cause, and untill this Court make further Order to the Contrary.
