1791. First Sittings [Thursday] Feb. 24.
Mr. Davies. When the Rule to shew Cause was made, I call’d on the Gentlemen, who moved it, to shew an instance in which any court of Law or Equity, has compell’d a Party who has sworn to a Debt to consent to discharge the Defendant on common Bail, because that party has sworn he owes nothing, therefore as they would proceed, notwithstanding the Caution I gave, the Rule must infallibly be discharged with Costs.
On the part of Colonel Martin it will appear he could never get from Mr. Maseyk any original and genuine accounts.
