The Court ordered him to be discharged.
Mr. Johnson, Objected that the Motion should be on Certificate of the Cause and time of Imprisonment, and that the Motion ought to have been intituled in the Cause in which the Commitment was Ordered: and he seems in strickness to be right in both Objections, but the Court thought it needless to keep the Man longer confined for such a nicety and he was discharged.
The Chief Justice said, The Cause is properly on the Civil side, until the Contempt is prosecuted, then it immediately becomes a Criminal Suit
