The Plaintiff Thomas Lyon had been Non-Suited in this Cause, and that being an Act of his own, though it is true it was because he saw the Court inclined to give Judgment against him, he can not probably get a Judgment for him, but suppose he could no other Judgment could be given except a reversal of the Record of the Non Suit, and then he must begin the Cause here again which he may now do, so that he can get nothing by the Appeal, and yet though he has been told so he is obstinate and will go on with his Appear.
He is a House Builder and is said to have made a large fortune here, and is now going to England, and intends to carry
