If he should be there advised not to prosecute his appeal, if he should not continue obstinate, he will not enter his Appeal before His Majesty in Council, and if he should not, I do not know how Chaund Holdar, is to get his Costs for taking out Copies of the Proceedings here, and sending them to England and preparing to answer the appeal. I do not know whether the forms of this Court of Appeal, commonly called the Cock-pit, will admit a Petition of the Respondent, for Coses against the Appellant for not prosecuting his Appeal. Nor whether he can enter the Appeal if the Appellant will not.
This Court of Appeal, I believe always reverses the Judgment, if the Appellant appears and the Respondent does not
