But I think this Practice is wrong, for they should see whether the Proceedings have been right, and affirm the Judgment if they have, even though the Respondent should not appear to support the Judgment that had been given in his facour.
In another Circumstance too I take the Practice of this Court to be wrong: they give too small Coses, perhaps forty of fifty Pounds, when the real Costs have been four or five hundred Pounds. I think they should give the real Costs and some times even more by way of punishment against an Appellant, who appeared to the Court to have entered a vexatious appeal.
