There is a very essential difference between an unlawful Act committed and a meer intention to do it.
The Company never having prosecuted any Person for the trafick under foreign flags, is a kind of General Licence. What a Man sees every House of Trade in Town openly do, he may well think it lawful for him to do.
The Plea is double and no Issue could be taken on it, it is therefore bad.
