To hear the Evidence in the other Cause, before we sate the Dammages in this because in the next Cause the Defendant might give Evidence if he would of his being poor.
[[Memorandum: Sir Robert Chambers consulted with me then formed a sort of statement of which the damages should be in this manner: as the other cases we had set a fine of 1,000 sicca rupees and imprisonment for one month: and as the plaintiff is entitled in a civil action to recover half punishment on a criminal suit, some feel damages and also so much in damages as will fully indemnify him for the real cost being in the criminal suit and the civil action; he then made the statement thus: for the fine which might have been set in the criminal prosecution if he had been convicted, 1,000 rupees: for an insolvent for one months imprisonment 5,000 rupees: for a full indemnification of all costs 500,000 rupees: in all 10,000 rupees; then we twice should have agreed to give 10,000 rupees in damages, but Impey appeared inclined to give only 1,000 or 5,000:]]
